These Terms of Service govern your use of the Confident Splash website and your purchase of products from us. By visiting the site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy.

Online store terms

You must be at least the age of majority in your place of residence, or use this site with the involvement of a parent or legal guardian. You may not use our products or services for unlawful purposes or attempt to interfere with the security or operation of the site.

Product information and safety

We work to display product descriptions, colors, images, sizing, prices, and availability accurately, but minor variations may occur between screens and physical products.

Confident Splash float swimsuits and their removable buoyancy bars are swim-learning aids only. They are not life jackets, personal flotation devices, rescue equipment, or substitutes for active adult supervision. A responsible adult must remain within arm's reach of the child in or near water. Check the suit, fit, closures, and all buoyancy bars before every use. Remove buoyancy bars gradually according to the child's demonstrated ability and confidence. Never rely on the product to prevent drowning.

Orders, prices, and payment

All prices are shown in USD unless clearly stated otherwise. We may correct errors, update prices, limit quantities, refuse or cancel orders, or request additional information when reasonably necessary. An order is accepted when we confirm it for fulfillment. If we cancel a paid order, the affected amount will be refunded to the original payment method.

Promotions

Promotional offers are subject to their stated terms, availability, and end dates. Unless stated otherwise, promotions cannot be combined. If part of a discounted bundle is returned, the remaining items may be repriced according to the promotion's eligibility rules.

Shipping and returns

Shipping estimates and return eligibility are governed by our Shipping Policy and Refund Policy, which form part of these Terms.

Intellectual property

The site content, including branding, text, graphics, photography, and design, is owned by or licensed to Confident Splash and may not be copied, reproduced, or commercially exploited without permission.

Third-party services

Our store is hosted by Shopify and may use third-party services for payments, shipping, analytics, and other functions. Third-party links and services may be governed by their own terms and policies.

Disclaimer and limitation of liability

To the fullest extent permitted by law, the site and services are provided on an “as available” basis. Nothing in these Terms excludes rights or remedies that cannot legally be excluded. Confident Splash is not liable for indirect, incidental, special, or consequential loss arising from use of the site or products, except where such limitation is prohibited by law.

Indemnification

To the extent permitted by law, you agree to indemnify Confident Splash against claims arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person's rights.

Changes, severability, and termination

We may update these Terms by posting a revised version on this page. If any provision is found unenforceable, the remaining provisions remain effective. We may suspend access to the site for fraud, abuse, security threats, or material violations of these Terms.

Governing law

These Terms are governed by the laws applicable to Confident Splash's operation and your mandatory consumer rights. Nothing in these Terms limits protections that apply to you under mandatory local law.
